§ 1. Definitions
1. Customer – a natural person of legal age and with full legal capacity who uses the services provided by the Organizer as defined in these Terms and Conditions, i.e., who purchases a ticket for a specific sporting event and lodging at the venue of the sporting event, acting on their own behalf or, alternatively, on behalf of and for the benefit of third parties. The Organizer shall also consider a legal entity to be a Customer if such entity wishes to use the Services offered by the Organizer. 2. Organizer – ZCNM Travel Spółka z ograniczoną odpowiedzialnością, with its registered office in Wrocław, ul. Niemczańska 33, 50 – 561, entered in the Register of Entrepreneurs of the National Court Register maintained by the District Court for Wrocław-Fabryczna in Wrocław, 9th Commercial Division of the National Court Register, under KRS number: 0001225599, Tax ID (NIP): 8993051537, Statistical ID (REGON): 544082376, whose current scope of services is available on the Website, 3. Terms and Conditions – these Terms and Conditions, 4. Website – the website operated by the Organizer, available at footballexpeditions.com, through which Customers may book Services, 5. Services – services offered by the Organizer consisting of acting as an intermediary in the purchase of admission tickets to a specific Sports Event and in the booking of accommodations at the venue of the Sports Event, excluding any services related to travel arrangements, transportation to the venue of the Sports Event, and any other services actually or potentially related to a specific Sports Event, such as sightseeing or organizing Customers’ leisure time. 6. Sporting Event – a specific sporting event, most commonly a soccer match, but also a basketball game, an American football game, a Formula 1 race, as well as any other organized mass sporting event, participation in which is facilitated by the Organizer and which takes place outside the borders of the Republic of Poland.
§ 2. General Provisions
1. These Terms and Conditions set forth the specific rules governing the provision of Services by the Organizer. 2. Use of the Website constitutes acceptance of the terms and conditions set forth in these Terms of Service. Acceptance of the terms and conditions set forth in these Terms of Service is voluntary but necessary to use the Website. 3. The Organizer makes the Terms and Conditions available free of charge and in a manner that allows any interested party to review them at footballexpeditions.com under the “Terms and Conditions” tab. 4. The Customer uses the Portal solely on their own behalf. If the Customer uses the Website on behalf of and for the benefit of third parties, they are required to hold the appropriate power of attorney to act on their behalf. Upon request by the Organizer, the Customer shall be required to demonstrate legal authority to act on behalf of and for the benefit of third parties. The Organizer shall not be liable in the event that the Customer acts without authorization on behalf of third parties, including, in particular, in the event of damage caused to a third party as a result of the Customer’s aforementioned unlawful actions.
§ 3. Nature of the Organizer’s Services
1. The Organizer is not a tour operator within the meaning of the Act of November 24, 2017, on Tourist Events and Related Tourist Services (i.e., Journal of Laws of 2020, item 2139, as amended). 2. The Organizer provides exclusively intermediary services for the purchase of admission tickets to various types of Sports Events organized outside the borders of the Republic of Poland, as well as intermediary services for arranging accommodations at the venue of the Sports Event. 3. As part of the services provided, the Organizer enables the User to purchase an admission ticket to a selected sporting event and to enter into a contract for hotel accommodations at the venue of the sporting event. 4. The Organizer does not act as an intermediary in the purchase of airline, bus, or train tickets, nor any other tickets enabling transportation to the venue of the sporting event. The Organizer also does not organize or act as an intermediary in organizing group trips to the venue of the Sports Event, nor does it take any action to ensure the Customer’s presence at the venue of the Sports Event or to facilitate the Customer’s return to the territory of the Republic of Poland after the conclusion of the aforementioned Sports Event. 5. The Customer is required to travel to the venue of the sporting event on their own and to return to the territory of the Republic of Poland on their own upon the conclusion of the sporting event. 6. In individual cases, the Organizer may provide the Customer with assistance during the trip, including assistance with purchasing airline tickets, arranging transportation from the airport, bus or train station, or any other public transportation hub used by the Customer to the venue of a specific Sports Event. As part of such services, the Organizer may assist in the purchase of airline, bus, train, or subway tickets, as well as in booking transportation provided by a taxi company or other means of transportation. The provision of the aforementioned services by the Organizer shall be solely at the Organizer’s discretion and shall be provided exclusively as a courtesy; it does not constitute a component of the Services provided by the Organizer. The Organizer assumes no liability whatsoever in the event of a flight cancellation, delay, or rescheduling, or other circumstances that render it impossible for the Customer to use the services described in this paragraph.
§ 4. The Organizer’s Current Offer
1. The Organizer makes the offer of currently available Sports Events, including accommodations, available on the website at footballexpeditions.com in a manner that allows the Customer to review them and make a selection. 2. The Organizer reserves the right to state that the offer, as defined in paragraph 1, is subject to separate agreements with its business partners on a case-by-case basis and may be subject to dynamic changes. The Organizer does not guarantee continuous access to currently available Sports Events, and their catalog is open-ended. 3. In light of the foregoing, the Organizer reserves the right to modify the offer as defined in paragraph 1 at any time, while respecting the rights of Customers who made and paid for a reservation prior to such modification. A change to the offer may not serve as grounds for any claims against the Organizer by Customers who have not made and paid for a reservation for a Service that has been altered as a result of such changes. 4. To avoid any ambiguity in interpretation, the Organizer stipulates that the offer referred to in paragraphs 1 and 2 does not constitute an offer within the meaning of the Civil Code, but merely an invitation to Customers to negotiate.
§ 5. Reservation Procedure
1. In order to book a specific Service offered by the Organizer, the Customer is required to submit a request by completing the registration form available on the Website, each time after selecting a specific offer as defined in § 4 of the Terms and Conditions. 2. A Service reservation is made by providing the Customer’s personal information and other identifying information required by the Organizer. 3. After selecting a specific service, the Customer will be redirected to an external website operated by a partner of the Organizer that enables payment. 4. To ensure a smooth booking process, the Customer is required to make payment immediately. During the period between the Customer’s selection of the Service and the provision of personal and identification information, and the successful completion of payment, the Organizer does not guarantee that other Customers will be prevented from booking and paying for the same Service. In such a situation, the booking will be considered successful for the Customer who is the first to complete a successful payment. 5. The Organizer allows for cashless payments via a payment platform. The Customer has the right to choose the payment method from among the options available on the payment platform. 6. Within twenty-four hours of payment, the Organizer will send a booking confirmation in PDF format to the email address provided by the Customer. 7. During the period from the time of payment until the booking confirmation is sent to the Customer, the Customer is required to refrain from purchasing airline tickets or arranging any other form of transportation to the selected Sports Event. 8. The Organizer shall not be liable if the Customer arranges transportation to the venue of the Sports Event—i.e., purchases airline, bus, or train tickets, etc.—despite the Organizer’s failure to confirm the reservation within 24 hours of the Customer’s booking and payment. In such a situation, the Organizer shall not be obligated, in particular, to ensure the Customer’s participation in the sporting event or to refund the funds paid. 9. The Organizer may change the accommodation in the event of technical issues. The Organizer is obligated to provide an alternative facility of the same or higher class. The Customer shall not incur any additional costs resulting from the need to change accommodations during the trip to the sporting event. The Organizer is obligated to inform the Customer of the need for a change as soon as technical issues arise.
§ 6. Technical Requirements
1. The Organizer conducts its activities exclusively remotely, via the website footballexpeditions.com and, in exceptional cases, also via email and the Organizer’s social media fan pages. 2. The customer is required to have a device with internet access that supports Internet Explorer 9.0 or a more advanced version, or another browser with similar specifications, such as Google Chrome version 30. 3. The Customer is also required to have an active email account and a cell phone number. 5. The Organizer reserves the right to impose additional requirements for using the footballexpeditions.com website, such as the installation of Java, JavaScript, or other software. The Organizer also reserves the right to require the acceptance of cookies as a condition for using the footballexpeditions.com website.
§ 7. Customer Obligations
1. At the time of booking, the Customer is required to possess valid identification documents that allow travel to the country where the sporting event is held. If additional documents or permits are required, the Customer is also required to obtain them independently. The Organizer does not provide any intermediary services regarding the acquisition of travel documents, visas, or any other documents of this type. 2. The Customer is required to comply with the laws of the country where the sporting event is held, including, in particular, compliance with current health regulations related to the spread of infectious diseases, with special emphasis on the SARS-CoV-2 virus, and the World Health Organization’s guidelines in this regard. 3. The Customer is obligated to cooperate with the Organizer in the provision of the Services rendered by the Organizer. 4. The Customer is required to have adequate travel insurance.
§ 8. Organizer’s Liability
1. The Organizer shall not be liable for any change in the date of the Sporting Event. In the event of a change in the date of the Sports Event, the Organizer may prepare a new offer at the Customer’s individual request for the new scheduled date of the Sports Event. In such a case, the amount paid by the Customer for participation in the aforementioned Sports Event, the date of which has been changed, will be credited toward the price of the new offer. 2. The Organizer shall not be liable for any delay, cancellation, or change in a flight, or any other circumstances related to the mode of transportation selected by the Customer, resulting in the Customer’s inability to participate in the selected Sports Event. In the cases described above, the Customer has no claims against the Organizer, including, in particular, a claim for a refund of the amount paid. 3. The Organizer is not liable for the Customer contracting SARS-CoV-2, for the Customer’s inability to get tested for the SARS-CoV-2 virus, for receiving a positive result on the aforementioned test, for undergoing an incorrect test, or for any actions that the Customer is required to take in order to participate in the selected sporting event. In the cases described above, the Customer has no claims against the Organizer, including, in particular, a claim for a refund of the amount paid as the price. 4. The Organizer shall not be liable for the Customer’s denial of admission to the Sports Event caused by the Customer’s actions or omissions, including, in particular, the Customer’s improper conduct or failure to fulfill the legal obligations incumbent upon the Customer under the laws generally applicable at the location where the Sports Event is held. 5. The Organizer shall not be liable for any damages the Customer may incur as a result of participating in the Sports Event. In particular, the Organizer shall not be liable for damage to the Customer’s property or personal injury sustained during actual participation in the Sports Event or while using accommodations.
§ 9. Nature of the Customer’s Rights
1. The Organizer reserves the right to state that admission tickets purchased by the Customer for a specific Sports Event may not constitute the Customer’s property within the meaning of civil law. Pursuant to the generally applicable laws in the location where the Sports Event is held, the purchase of specific admission tickets through the Organizer grants the Customer only the right to participate in the given Sports Event, without the ability to freely dispose of the tickets. In the case described above, the Customer is merely the user of the ticket. 2. The nature of the Customer’s rights in connection with the purchase of tickets will depend in each case on the legal regulations in effect at the venue where the sporting event is held. The Organizer will inform the Customer in each case of the rights to which they are entitled, in accordance with the regulations in effect at the venue where the sporting event is held. 3. The Organizer reserves the right to stipulate that, based on specific legal regulations in effect at the venue of the sporting event, the Customer may, in particular, be prohibited from reselling a ticket, including, in particular, the subsequent resale of a ticket purchased through the Organizer on the open market. 4. The Organizer reserves the right to state that, pursuant to specific legal regulations in effect at the venue of the sporting event, the resale of tickets may result in the Customer being held liable under administrative, financial, or criminal law. 5. Any intention by the Customer to transfer the rights to purchased tickets to third parties requires contact with and cooperation from the Organizer. Independent transfer of such rights is not permitted. 6. The Organizer will facilitate the transfer of rights to purchased tickets to third parties only if it obtains the necessary consent from its business partners who are ticket distributors, or the consent of the competent authorities at the location where the sporting event is held. 7. The Customer has the right to freely dispose of the right to lodging obtained as a result of the Services provided by the Organizer.
§ 10. Cancellation of Reservations
1. The Organizer reserves the right to cancel the Customer’s reservation in the event of the cancellation of the sporting event, a change in its date, the inability to purchase admission tickets to the sporting event, the inability to provide accommodations at the venue of the sporting event, or other circumstances that actually prevent the sporting event from being held on the stated date. 2. The Customer has the right to cancel the reservation. Canceling the reservation before payment is made does not incur any costs for the Customer. Canceling the reservation after payment has been made is possible only if the Customer simultaneously cancels the reservation and transfers it to another third party. The Organizer allows the Customer to cancel the reservation without transferring it to another person; however, in such a case, the Customer is not entitled to a refund of the amount paid. 3. A reservation may also be canceled in the event of force majeure, such as sudden weather events, states of emergency, infectious disease epidemics, or national or international legal regulations that prevent the organization of sporting events, the operation of hotel services, or entry into or departure from a given country.
§ 11. Complaint Procedure
1. The Customer has the right to file a complaint if they believe that the Organizer provided the Services in a manner inconsistent with the provisions of these Terms and Conditions, including, in particular, in the event of failure to deliver or incorrect delivery of the reserved tickets to the Customer, or failure to provide the Customer with accommodations, or provision of accommodations that do not correspond to the Customer’s reservation. 2. To file a complaint, the Customer must send an email to biuro@footballexpeditions.com within 14 days of the occurrence of the circumstances that, in the Customer’s opinion, justify filing the complaint. 3. The email referred to in paragraph 2 should be titled “Complaint” and include a brief description of the Service to which it relates. In the body of the email, the Customer must describe all circumstances justifying the complaint and specify the nature of the claims being asserted against the Organizer. 4. The Organizer will review the complaint within 14 days of receiving the email referred to in paragraph 2. Regardless of the outcome of the complaint process, the Organizer will notify the Customer upon completion of the review, indicating whether the complaint was deemed valid or not. 5. If the complaint is upheld, the Organizer undertakes to satisfy the claim submitted by the Customer, to the extent permitted by factual and legal circumstances. If it is not possible to directly satisfy the claim, the Organizer will agree with the Customer on a method of compensation.
§ 12. Adequate Travel Insurance
1. By deciding to purchase this service, you confirm that all persons traveling to the sporting event will have adequate travel insurance, and that you have read and understood the above terms and conditions and information.
§ 13. Processing of Personal Data
1. The Organizer is the controller of Customers’ personal data within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter also referred to as “GDPR,” 2. The Organizer processes the following personal data of Customers: first and last name, PESEL number, ID card number or passport number, date of issuance and expiration date of the selected identity document, and the Customer’s residential address. 3. The Organizer processes the Customer’s data solely for the purpose of providing the Service to the Customer and only for the period necessary to provide the Service. 4. The processing of the Customer’s data will be based on consent, i.e., pursuant to Article 6(1)(a) of the GDPR. 5. Recipients of the Customer’s personal data may include entities supporting the Organizer in its business operations, in particular entities providing the Organizer with business and financial consulting services, legal services, and IT services, as well as entities affiliated with the Organizer through capital or personal ties. 6. The Customer’s personal data will be stored by the Organizer for the time necessary to perform the Service, but no longer than 1 year from the date of consent to its processing or no longer than until such consent is withdrawn. 7. In connection with the processing of personal data, the Client has the right to access, rectify, delete, or transfer their personal data, or to restrict its processing. The Customer also has the right to withdraw their consent at any time; however, such withdrawal will not affect the lawfulness of processing carried out on the basis of their consent prior to its withdrawal. 8. The Customer also has the right to file a complaint with the supervisory authority—the President of the Personal Data Protection Office 9. Providing personal data is voluntary; however, it is necessary to enable the Organizer to properly perform the Service. 10. The Customer’s personal data will be processed in IT systems; however, the Organizer will not make decisions in an automated manner, including through profiling.
§ 14. Final Provisions
1. In matters not covered by these Terms and Conditions, the provisions of generally applicable law shall apply. 2. The Organizer reserves the right to amend the provisions of these Terms and Conditions at any time. Any amendments to these Terms and Conditions shall take effect upon their publication on the Website, under the “Terms and Conditions” tab.
